Blog: Call to Action: The Recover Act of 2026—Removing Excessive Cuts to Rehab

This call to action is an opportunity to support the RECOVER Act of 2026 (Removing Excessive Cuts to Outpatient and Vital Essential Rehabilitation Act of 2026), which seeks to remove the MPPR reduction from fee schedule reimbursement for rehabilitation services.

Congresswoman Ross introduced this legislation, noting it would repeal a “flawed policy that has increased costs and arbitrarily slashed reimbursement for certain providers since 2013.”

Over a decade ago, CMS implemented the Multiple Procedure Payment Reduction (MPPR) to the fee schedule, resulting in reduced reimbursement for SNF and outpatient therapy services.

How MPPR is applied now:

When more than one therapy service is delivered on the same day, only the first service is fully reimbursed. All subsequent services are subject to a 50% reduction in the practice expense portion. The practice expense portion of the fee schedule amount accounts for approximately 45% of the total value.  

RECOVER Act of 2026 proposed amendment to Title XVIII of the Social Security Act:

For the Physician Fee Schedule, outpatient therapy services, and comprehensive outpatient rehabilitation, proposed language replaces the 50% reduction language to 0% reduction.

The Point Is: As American Physical Therapy Association (APTA) President Kyle Covington noted, “MPPR undermines coordinated care and does not reflect clinical realities. The RECOVER Act gives Congress a clear opportunity to correct this outdated policy and put patients first.”
