Positive responses continue to make headlines following the Monday, April 7th ruling made by Judge Kacsmaryk from the US District Court of North Texas in favor of the American Health Care Association (AHCA), LeadingAge, and several nursing homes’ fight against CMS’s staffing mandate, throwing out the RN minimum hours per resident day requirements.
“The Court has confirmed that CMS does not have the authority to issue such staffing requirements, only Congress does,” Clif Porter, AHCA’s President said.
Katie Smith Sloan, LeadingAge President and CEO, expressed a similar view: “Our stance has always been clear: Imposing mandates rather than addressing funding adequacy and workforce sufficiency is wrong-headed.”
Advocacy efforts continue with a goal to ensure the court’s ruling will stand, as the Administration has 60 days to decide whether to appeal.
